The Island Retreat (“we,” “us,” “our”) provides this Site to share information about our resort, accommodations, and services, including weddings and private events. By accessing or using this Site, you agree to be bound by these Terms and Conditions.

1. Use of the Website

This Site is provided for personal, non-commercial use. You agree to use it lawfully and refrain from interfering with its functionality, content, or the use of other users.

2. Bookings and Reservations

Reservations made through this Site, through direct communication with the property owner, or Reservation Key must be for your personal use or that of your invited guests. The following actions are strictly prohibited:

  • Reselling or transferring reservations.

  • Listing reservations on third-party websites.

  • Making speculative, false, or fraudulent reservations.

  • Booking without a genuine intent to stay.

Violations may result in cancellation, restriction of access, or account suspension.

Reservations are subject to availability and are not final until confirmed. By booking accommodations or services, you agree to provide accurate information and comply with:

  • Property policies, including check-in and check-out times, as well as house rules.

  • Payment requirements and cancellation terms.

  • Maximum occupancy and safety guidelines.

We reserve the right to modify or cancel reservations at our discretion.

3. Cancellation & Refund Policy

This section outlines the official Cancellation and Refund Policy applicable to all guests, including event and accommodation bookings.

3.1 General Cancellation Window

  • Confirmed reservations may be modified or canceled up to 90 days before the scheduled check-in date.

  • Modifications are subject to availability and may involve rate changes or a new cancellation policy.

3.2 Right to Cancel or Modify

We reserve the right to cancel or modify reservations at our sole discretion, including when:

  • Fraud, error, or misuse is suspected.

  • Reservations are found to violate our terms or policies.

Guests may contact Customer Support to contest a cancellation or request assistance.

3.3 Power Outages & Service Disruptions

  • Outages <24 Hours: No compensation will be issued.

  • Outages >48 Hours: Guests receive a 50% refund for the second night and a full refund for all subsequent affected nights. We will assist with alternative accommodations.

3.4 Inability to Arrive

If travel to Elbow Cay becomes impossible due to unforeseen events (e.g., flight cancellations, weather disruptions), we will honor your reservation for a future stay within one year of the original check-in date. For cancellations, date changes, or refund inquiries, contact Customer Support directly.

4. Privacy Policy

Please refer to our Privacy Policy for how we collect and use your data.

5. Property & Content Ownership

All Site content, including images, text, videos, and logos, is the intellectual property of The Island Retreat or its licensors. You may not reuse or republish materials without written permission.

6. Links to Third-Party Websites

This Site may contain links to external websites. We do not control or endorse those sites and are not responsible for their content, terms, or privacy practices.

7. Limitation of Liability

The Site is provided “as is.” We make no warranties or guarantees regarding its availability, accuracy, or reliability. To the maximum extent permitted by law, The Island Retreat disclaims all liability for direct or indirect losses incurred through use of this Site or any associated services.

8. User Conduct

You agree not to:

  • Upload harmful content or malware.

  • Violate any laws or regulations.

  • Impersonate others or misuse the Site for unlawful activity.

9. Governing Law

These Terms are governed by the laws of the Commonwealth of The Bahamas. Any disputes shall be subject to the exclusive jurisdiction of the Bahamian courts.
