BEACH & OCEAN ACTIVITES LIABILITY WAIVER

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT Surfing and sailing demonstrations are offered for your enjoyment. Please be advised that participation is voluntary and at your own risk; The Island Retreat and its affiliates are not liable for injury, loss, or accidents during participation; you must sign a liability waiver before joining any surf or sail session; and a parent or guardian must accompany all minors.

PLEASE READ CAREFULLY BEFORE PARTICIPATING

By participating in or observing any surfing, sailing, or other ocean-related activities (the “Activities”) offered during Nashville on the Rock at The Island Retreat, I acknowledge and agree to the following:

Assumption of Risk
I understand and acknowledge that participation in surfing and sailing involves inherent risks, including but not limited to drowning, physical injury, impact with boards or other participants, exposure to changing weather conditions, and risks associated with ocean currents and marine life.
Release and Waiver of Liability
I hereby release, waive, and discharge The Island Retreat, its owners, operators, affiliates, sponsors, employees, event organizers, volunteers, and any associated instructors (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my property while participating in the Activities, regardless of whether caused by the negligence of the Released Parties.
Indemnification
I agree to indemnify and hold harmless the Released Parties from any and all claims, suits, damages, costs, and expenses, including attorney’s fees, arising from or in connection with my participation in the Activities.
Medical Acknowledgment
I certify that I am physically fit and have no known medical conditions that would prevent me from safely participating in the Activities. I authorize the organizers to seek emergency medical treatment if necessary and understand that I am solely responsible for any related costs.
Photography and Media Release
I grant permission for photos or video footage taken during the Activities to be used in promotional or editorial materials by The Island Retreat and its affiliates.
Governing Law
This agreement shall be governed by the laws of the Commonwealth of The Bahamas, and any disputes shall be resolved in its applicable courts.

Participants and their guardians agree to waive the following rights:

PLEASE READ CAREFULLY BEFORE SIGNING. THIS FORM AFFECTS LEGAL RIGHTS.

As the parent or legal guardian of a minor participant (“Child”) in any surfing, sailing, or ocean-related activity (the “Activities”) offered during Nashville on the Rock at The Island Retreat, I acknowledge and agree to the following:

1. Assumption of Risk

I understand that surfing and sailing involve inherent risks including, but not limited to, drowning, collisions, falls, equipment failure, changing ocean conditions, strong currents, exposure to the elements, and interactions with marine life. I voluntarily allow my Child to participate in the Activities and accept full responsibility for these risks on their behalf.

2. Waiver and Release of Liability

On behalf of myself and my Child, I hereby release, waive, and discharge The Island Retreat, its owners, employees, affiliates, event organizers, volunteers, and all associated instructors or entities (the “Released Parties”) from any and all liability, claims, demands, damages, or causes of action arising out of or related to injury, disability, property damage, or death sustained by my Child while participating in the Activities, whether caused by the negligence of the Released Parties or otherwise.

3. Indemnification

I agree to indemnify and hold harmless the Released Parties from any and all claims, liabilities, damages, and expenses (including attorney’s fees) resulting from or in connection with my Child’s participation in the Activities.

4. Medical Acknowledgment

I confirm that my Child is physically fit and has no known medical condition that would prevent safe participation. In the event of an emergency, I authorize medical treatment and accept full financial responsibility for any resulting costs.

5. Photography & Media Consent

I grant permission for The Island Retreat and its partners to use photographs or videos of my Child taken during activities for promotional and editorial purposes, without compensation.

6. Governing Law

This agreement is governed by the laws of the Commonwealth of The Bahamas. Any disputes shall be resolved under its jurisdiction.
